Public Liability Claims

If you have been injured on a public or private property as a result of another party’s negligence, you may be able to claim compensation under the Civil Liability Act 2002.

Types of claims include:

  • Slips, trips and falls on public or private property such as:
    • Shopping centres
    • Business premises
    • Rental properties
    • Gyms
    • Roads, footpaths or carparks
    • Schools
  • Dog or animal attacks
  • Sporting accidents

If you have a public liability claim, you may be entitled to claim:

  • Compensation for non-economic loss (i.e. pain and suffering)
  • Loss of income and loss of earning capacity
  • Medical and treatment expenses.
  • Personal care and domestic assistance, including the commercial value of care provided by family members or friends.

Most claims are covered by public liability insurers. However, there is no obligation on a negligent party or insurance company in a public liability claim to pay for loss of income or medical expenses while you are recovering from your injury and before a claim is settled. In fact, in most cases, negligent parties and/or their insurer will do everything they can to reject the claim. In those circumstances, public liability claims have to be litigated in Court.
